Terms of Service

These Terms of Service form a legally binding agreement between you and webservicess ("webservicess", "we", "us"), based in Toronto, Canada and Singapore. By creating an account, signing in, or using any part of our service, you confirm that you have read, understood and agree to these terms.

If you do not agree, do not create an account or use the service. You must be at least 18 years old, or the age of majority in your country, to open an account.

webservicess provides (a) hosted partner webpages designed and maintained by us, (b) a self-serve marketplace where sellers can create and brand their own online shop and list products, and (c) related tools such as accounts, favourites, reviews, orders and AI-assisted features.

We may add, change or remove features at any time. We may suspend or end the service, or your access to it, where reasonably necessary, for example for security, legal or maintenance reasons.

You are responsible for keeping your sign-in details confidential and for everything that happens under your account. Provide accurate information when you register and keep it up to date.

We may suspend or close accounts that break these terms, misuse the service, or create risk for other users.

Sellers: you are solely responsible for your shop, your listings, your prices, your products and your compliance with the laws that apply to you, including consumer protection, tax and product safety rules in Sri Lanka and anywhere you sell. You must only list products you have the right to sell, and your listings must be accurate and not misleading.

New shops are reviewed by webservicess before they go public. Approval does not mean we endorse, verify or guarantee a seller or their products.

Buyers: purchases are agreements between you and the seller. webservicess is not the seller of marketplace products and is not a party to those transactions. Questions about products, delivery, returns and refunds should be raised with the seller first.

Payments on the marketplace are currently processed through a mock or third-party checkout. Do not rely on the marketplace for payment disputes; contact the seller and your payment provider.

We may remove listings, shops or reviews that are unlawful, misleading, infringing, unsafe or otherwise breach these terms.

Some features use artificial intelligence, for example generating theme suggestions from a link or image you provide. AI output is generated automatically and may be inaccurate, incomplete or similar to output given to others.

You are responsible for reviewing anything AI generates for you before you use or publish it. Do not upload content you do not have the right to use. AI suggestions are provided "as is" and we do not guarantee they are unique, accurate or suitable for any purpose.

We may use the content you submit to AI features to provide and improve those features, in line with our privacy practices.

You keep ownership of the content you upload, such as logos, photos, product details and shop text. By uploading it, you give webservicess a worldwide, non-exclusive, royalty-free licence to host, display, reproduce and adapt that content as needed to operate and promote the service.

You confirm you own or have permission to use everything you upload, and that it does not infringe anyone's rights. We may remove content that breaches these terms.

You must not: break any law; post false, harmful, hateful or infringing content; sell prohibited, counterfeit or unsafe goods; scrape, copy or interfere with the service; attempt to access other accounts; or use the service to spam or deceive others.

Some services are paid, such as website packages. Prices are shown on the site and may change with notice. Marketplace selling is currently free; if we introduce fees in future, we will give reasonable notice before they apply to you.

The service is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties about availability, accuracy or fitness for a particular purpose.

To the fullest extent permitted by law, webservicess is not liable for indirect or consequential losses, lost profits, lost data, or for the acts, products or content of sellers, buyers or other third parties. Our total liability to you is limited to the amount you paid us in the 12 months before the claim, or 100 USD if you paid nothing.

Nothing in these terms excludes liability that cannot be excluded by law.

You may stop using the service and ask us to close your account at any time. We may suspend or close your account if you breach these terms. Sections that by their nature should survive, such as liability and content licences needed to run the service, survive closure.

We may update these terms from time to time. If we make material changes, we will give reasonable notice on the site or by email. Continuing to use the service after changes take effect means you accept the updated terms.

These terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-law rules, unless the law of your country of residence gives you mandatory protections, in which case those apply.
